A Grade I Area Court in Kubwa, Abuja, on Thursday dissolved a 13-year-old marriage between Maimuna Isah and her husband, Usman Ahmodu by way of khula.
Khula is a procedure through which a woman can divorce herself from her husband in Islam, by returning the bride price and everything she received from him during their life together, or without returning anything, as agreed by the spouses or judge.
The judge, Musa Sabo, dissolved the marriage according to Islamic Law, following Maimuna’s prayer for divorce by way of khula on grounds of dislike.
Sabo ordered Maimuna to refund the dowry of N10,000 back to Ahmodu and cited Order 9 rule 3 (1) of the Area Court Civil Procedure rules which stipulates that: “When a civil cause is called for hearing or at any adjournment of the hearing, if the plaintiff appears and the defendant does not, the court may, on due process of the service, proceed the hearing and determination of the cause on the fact of the plaintiff only,” he held.
Earlier, Maimuna had told the court that she got married to Ahmodu under Islamic Law in 2011 and the union was blessed with a 12-year-old son and a 10-year-old daughter. She, however, told the court that she had lost interest in the marriage and would no longer obey Ahmodu’s commandments.
“I fear disobeying Almighty Allah as a result. I am ready to refund the bride price of N10,000 to the respondent,” she said.
She prayed to the court to dissolve her marriage by way of Khula.
The respondent, however, did not appear in court after being served the processes.(NAN)
